    Compulsory licenses for patents have been incorporated to Chilean legislation, but only in case of monopoly abuse of the right holder, circumstances which is qualified by a special court which deals with economic cases. compulsory license may be grant only under non exclusive basis, must have an specific duration and the licensee must pay a royalty to the right holder.
